Supreme Court Verdict: Students cannot be promoted without exams but deadline is not mandatory for conducting exams
The Apex Court of India has said that final year university exams will be conducted as per the rules of University Grants Commission. Top Court has also said that states cannot promote students without holding exams.
A bench headed by Justice Ashok Bhushan announced the judgement on the student plea against UGC. This implies that all final year university exams will have to be conducted.
However, the apex court said that of any state government or union territory cannot conduct exams by the September 30, UGC deadline, then they can individually approach the UGC to postpone it.
"State disaster management authority (SDMA) can postpone exams overriding UGC guidelines. However, SDMA cannot ask institutes to pass students based on previous performances." said the apex court.
Supreme Court also added that states/UTs cannot promote/pass students without conducting exams as directed by UGC but they have the right to approach the body seeking a postponement of the deadline, if the COVID-19 crisis is not under control yet.
MY OPINION:
The judgement by Supreme Court was a good decision. It gave the judgement by taking both aspects of students health and their future. The exams will be conducted after COVID-19 crisis and this makes students to not miss their academic year. Given the current pandemic situation, it is good that Supreme court has allowed flexibility to conduct exams. Finally, it is a positive move by top court of our country.
